Eckhart Rigbert Charged with Five Felonies in Henry Johnson Hit and Run

Ian Eckhart Rigberg, the young man who killed Rozell Whitehead on Henry Johnson Blvd and left him to die…and then lied about the incident to the police, is now charged in a nine count indictment handed up from the Grand Jury on May 18th. My vehicular prosecuting hero, Mary Tanner Richter (MTR) is the star ADA bringing the charges.

Eckhart Rigberg stood beside his attorney Mark Mishler, his parents in the courtroom and pleaded not guilty to all nine charges with five of the charges being felonies. The top count is Manslaughter Two, a C Felony, followed by Ciminally negligent homicide, leaving the scene, lying to the cops various other charges.

Eckhart Rigberg’s next court appearance will be July 9th and he remains free on bond.

15 New Albany Firefighters Sworn

afd fire departmentOn Tuesday morning, the City of Albany welcomed 15 new Firefighters into the family and I’m glad to see a bit more diversity with each class…yup, they had short and tall Firefighters! Now we need more women Firefighters!

Now, Bryan Fitzgerald, over at the TU did a decent story on the event so follow this link if you want all the details. (Funny, I didn't see him there!) I was in the middle of two other “events” so I ran in, took some pics…watched a few new firefighters proudly sign the book and I grabbed a program. Cause, I want to be sure that each and every new member of the Fire Department is honored for his future dedication to our City.

And here they are….our recruit Firefighters:

Daily Dose of Soares

For those of you asking about my coverage of Mr. Soares’ girlfriend, I will not be covering her transfer, heck, I suggested it. Certainly there are a lot of concerns out there but I know the woman to be very nice, a hard worker and one of the more efficient on the DA staff. Her relationship is her business…the bad decisions in the relationship between the DA and his staff member belong solely to the DA and I’ll not drag an innocent through the mud. That said, another bad and embarrassing decision by the DA (involving that girlfriend), is described here by our friend up at Saratoga in Decline. Here are some excerpts for those who refuse to click through but be sure to pay the guy a visit for the whole story, live links and the reader’s comments.

Every once in a while, I notice when a new reader comes onto the blog. That’s especially true when the new reader happens to be sitting in the Executive Office of the White House!

Didn't Fall Far From the Tree

There is a young woman on trial in Albany County for the crime of being stupid. Her actual charge is one single marijuana charge. If there is anyone in this world who seems to attract bad elements, it is this girl. Her name is Eva and I’ve known her for several years. Everyone has known an Eva, she’s that girl that you just want to shake a few times and say…stop hanging out with “those types!” You probably won’t find it hard to believe that I have told her that an awful lot!

Anyway, this frightened, pregnant mother of two signed for a package full of marijuana delivered to her last bad decision…she signed for the package. The “bad decision” is now letting Eva take the rap although I delight in the fact that he will be taking the witness stand. At this point in the trial we are mid-jury selection and an interesting party was called to the jury box for voir dire. Her name may be familiar to you…Janay Willingham.

Now, I don’t make a practice of talking about potential jurors…unless, of course, they lie to the judge. So, Janay saunters up to fill a vacated jury seat and she must catch up with the rest of the jury questioning. When she is asked if she has any dealings with the DA or law enforcement…a sweet little “no” pops out of her mouth as she slightly slants her head.

Janay volunteers that her auntie and grandmother are involved in politics one being a County Legislator (I add FORMER in my head) and President of the Common Council. Great…I think, I was trying to get verification that this Janay Willingham indeed a “Willingham” direct relative a potentially carrying on the rumored family business. Janay sat through the voir dire as I pulled up her face on my “smart” phone waiting to show the judge.

Then at the very last minute before the judge let the attorneys question the jury, Janay’s hand shot up in the air…she asked to approach the bench. I held my breath…would she share her “interactions” with law enforcement with the Judge? Nope, seems Janay had some prejudicial issues with the defendant…she, I was told, thought the defendant was “promiscuous” (as she was pregnant) and a drug addict because of the single marijuana charge…she was excused for her judgmental attitude.

It was during the break that I shared Janay’s real issue with the attorney…as they were explaining, Miss Manner’s (Janay’s) prejudices toward the defendant to me, I flashed the police blotter from April 22, 2011 with Janay’s picture and pedigree…she was arrested for prostitution, marijuana and a third charge of criminal possession of a controlled substance.

[Update: Here's the story...the day after this alleged prostitute and druggie was released from jury duty, the defendant she looked down her nose at had all charges dismissed as the actual guilty person stepped forward. Here's the story.]
